Finally switched my appeal strategy after a denial hearing last month
I was dead set on pushing my mental health records as the main issue for 2 years, but a disability lawyer in Phoenix told me my physical conditions had clearer documentation. She showed me how my knee surgery records from 2019 lined up perfectly with the SSA's listing for joint issues. Anyone else had to totally pivot their focus after getting a lawyer's perspective?
Did @price.ray's lawyer mention anything about how the SSA actually evaluates mental health claims compared to physical ones? I've read that mental health records get scrutinized way harder because they're more subjective than something like an MRI or surgical notes. It makes sense that your lawyer pushed the knee issue since hard evidence is harder for them to argue against.
My cousin had a similar thing happen, where they mostly used his back surgery records even though his anxiety was the real issue. @price.ray hit the nail on the head about the lawyer playing chess while the SSA plays checkers, honestly. It's way easier to win with a torn ACL than a documented history of panic attacks, which is dumb but true.
